These Terms of Service (“Terms”) are a legally binding agreement between you and Curly Lifestyles Media Inc. (“Curly Lifestyles,” “we,” “us,” or “our”) governing your access to and use of curlylifestyles.com and the websites, accounts, features, content, products, services, quizzes, contributor features, contests and other offerings operated by Curly Lifestyles that link to these Terms (collectively, the “Services”).
Curly Lifestyles Media Inc. is an Ontario, Canada corporation.
Please read these Terms carefully before using the Services.
1. Acceptance of These Terms
By accessing or using the Services, creating an account, submitting content, entering a contest, purchasing a product, or otherwise using a feature that refers to these Terms, you acknowledge that you have read and understood these Terms and agree to be bound by them to the extent permitted by applicable law.
Certain activities may require you to affirmatively indicate your agreement, including by selecting an “I agree,” “Accept,” or similar checkbox or button.
If you do not agree with these Terms, do not use the applicable Services.
Electronic acceptance of these Terms is intended to have the same legal effect as acceptance of a written agreement where permitted by applicable law.

If specific terms for a contest, promotion, product, submission, event or other activity conflict with these general Terms, the more specific terms will govern that activity to the extent of the conflict.
3. Eligibility and Age Requirements
Curly Lifestyles is intended for individuals who are 13 years of age and older.
If you have not reached the age at which you may legally enter into a binding contract where you live, your parent or legal guardian must review and agree to any contractual terms that require their authorization.
Purchases, contributor arrangements, content licences, contests, promotions and certain other activities may have additional age requirements.
Individuals who have not reached the age of majority where they live may require the involvement or authorization of a parent or legal guardian to make purchases, grant certain rights, submit certain content or participate in particular activities.
Curly Lifestyles may impose a higher age requirement for a particular feature where appropriate or legally required.
4. Accounts
Certain features may allow or require you to create an account.
You agree to provide information that is accurate and reasonably current and not to impersonate another person or create an account using information you are not authorized to use.
You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account to the extent reasonably within your control.
You should notify us promptly at info@curlylifestyles.com if you believe your account has been accessed without authorization.
Accounts are personal unless Curly Lifestyles expressly permits a business, contributor or organizational account.
You may not sell, transfer or fraudulently share an account.
5. Suspension and Termination of Accounts
Curly Lifestyles may restrict, suspend or terminate access to an account or feature where we reasonably believe it is necessary because of:
fraud or suspected fraud; unlawful conduct; harassment; abuse; security concerns; intellectual-property infringement; misuse of the Services; material violation of these Terms; attempts to manipulate contests, orders or accounts; or conduct that threatens Curly Lifestyles, its users, service providers or others.
Where appropriate and practicable, we may provide notice.
Nothing in this section limits rights that cannot legally be restricted.
Termination of an account does not automatically require Curly Lifestyles to delete previously published editorial material, contributor articles, photographs, interviews or other material that we are lawfully entitled to retain.
6. Curly Lifestyles Editorial Content
Curly Lifestyles is a media publication.
Our content may include articles, guides, interviews, photography, videos, social-media content, quizzes, product coverage, cultural reporting, fashion and beauty coverage, event and red-carpet reporting, street interviews, celebrity coverage, opinions, commentary and other editorial material.
Editorial content may be updated, corrected, supplemented, reformatted or removed over time.
Publication of information about a person, company, product, salon, hairstylist, service, event or other subject does not necessarily constitute an endorsement.
We may determine, in our editorial discretion, what we publish, how it is presented, how long it remains available and whether it is updated or corrected, subject to applicable law and any agreement we have expressly made.
7. Intellectual Property Owned by Curly Lifestyles
Except for content owned by contributors, licensors or other third parties, the Services and their contents are owned by or licensed to Curly Lifestyles Media Inc. and may be protected by copyright, trademark and other intellectual-property laws.
This includes, as applicable:
articles; original photographs and videos; graphics; layouts; designs; logos; branding; compilations; databases; quizzes; quiz questions; written copy; guides; digital products; website elements; and other original Curly Lifestyles material.
The name Curly Lifestyles, our logos and our other branding may not be used in a way that falsely suggests sponsorship, affiliation, approval or endorsement.
Nothing in these Terms transfers ownership of Curly Lifestyles intellectual property to you.
8. Limited Permission to Use Our Content
Curly Lifestyles grants you a limited, personal, non-exclusive, non-transferable and revocable right to access publicly available Services for your lawful personal and non-commercial use, subject to these Terms.
Ordinary sharing of a link to a Curly Lifestyles webpage is permitted.
Brief quotation of material may also be permitted where authorized by applicable copyright law.
Except where expressly permitted by Curly Lifestyles or applicable law, you may not reproduce, republish, sell, redistribute, commercially exploit or create unauthorized derivative products from substantial portions of Curly Lifestyles content.
Purchasing a digital product does not transfer the copyright in that product.
9. Automated Access, Scraping and Artificial Intelligence
Except with our prior written permission or as expressly permitted below, you may not use automated or manual means to systematically access, collect, scrape, crawl, harvest, extract, reproduce, store or aggregate Curly Lifestyles content or data.
Without limiting the above, you may not use Curly Lifestyles content, metadata or data to:
develop, train, fine-tune, evaluate, test or improve an artificial-intelligence, machine-learning, foundation or generative model;
ground or augment an artificial-intelligence system, including through retrieval-augmented generation;
create datasets for artificial-intelligence or machine-learning purposes;
generate a competing or substitutive content service;
systematically summarize or reproduce our publication in a manner that substitutes for accessing Curly Lifestyles; or
commercially exploit scraped or extracted Curly Lifestyles material.
General-purpose search engines may use automated tools to access publicly available pages solely for the purpose of creating a conventional searchable index that directs users to the original Curly Lifestyles webpages, subject to our technical controls and applicable law.
Permission for conventional search indexing does not constitute permission for artificial-intelligence training, model grounding or unrelated data extraction.
The fact that technical measures do not prevent a particular form of access does not constitute permission for that access.
10. Prohibited Uses
You may not use the Services to engage in unlawful, fraudulent or harmful conduct.
This includes attempting to compromise website security; distributing malware; circumventing access or security controls; interfering with the operation of the Services; accessing another person’s account without authorization; impersonating another person; harvesting personal information; sending spam; submitting fraudulent orders or contest entries; infringing intellectual-property, privacy or publicity rights; threatening or harassing others; publishing knowingly false or defamatory material; or encouraging another person to engage in prohibited conduct.
You may not use Curly Lifestyles in a way that falsely suggests that Curly Lifestyles sponsors, endorses or is affiliated with you, your company, product or service.
11. User and Contributor Submissions
Curly Lifestyles may allow users or contributors to submit articles, stories, photographs, videos, quotations, biographies, comments, reviews, interviews or other material (“Submitted Content”).
You retain ownership of copyright you hold in your original Submitted Content.
Submitting content does not transfer ownership of your original work to Curly Lifestyles except where a separate written agreement expressly states otherwise.
However, Curly Lifestyles requires sufficient rights to review, edit, publish, distribute, archive and promote submitted material.
12. Licence You Grant to Curly Lifestyles
By submitting content for publication or public display through Curly Lifestyles, you grant Curly Lifestyles Media Inc. a non-exclusive, worldwide, royalty-free, fully paid-up licence to use the Submitted Content for Curly Lifestyles’ editorial, publishing, archival, distribution and promotional activities.
That licence includes the right to:
review, reproduce, publish, display, distribute, transmit, communicate, format, resize, crop, excerpt, caption, translate, adapt for accessibility, edit for length or clarity, create reasonable editorial adaptations, archive and promote the Submitted Content;
publish it on curlylifestyles.com;
publish or promote it through Curly Lifestyles social-media accounts, newsletters, video channels and other media channels;
create excerpts, clips, thumbnails, previews or promotional versions;
include advertising alongside or around published content;
and authorize vendors, hosting providers, social platforms and other service providers to process or display the material as reasonably necessary to carry out those purposes.
The licence may be sublicensed only as reasonably necessary to operate, distribute, archive or promote Curly Lifestyles and the Submitted Content.
The licence does not, solely by virtue of these Terms, give an unrelated sponsor the right to use your identity or Submitted Content in its own separate advertising campaign as though you personally endorsed that sponsor.
Unless a separate agreement states otherwise, contributors are not entitled to royalties or other compensation merely because Curly Lifestyles publishes, promotes or monetizes content submitted on an unpaid basis.
13. Duration of the Submission Licence
For content that Curly Lifestyles publishes, the licence described above is intended to be ongoing and irrevocable to the extent reasonably necessary to maintain, archive, distribute and promote the published work, subject to applicable law.
Closing an account or later asking to withdraw a contribution does not automatically terminate rights already granted for content that has been published.
Curly Lifestyles may nevertheless consider removal requests case by case.
Nothing prevents a contributor from publishing their original work elsewhere because the licence granted to Curly Lifestyles is non-exclusive, unless a separate agreement says otherwise.
14. Editing and Editorial Control
Submitting material does not guarantee publication.
Curly Lifestyles may accept, reject, postpone, edit, headline, categorize, format, update or remove material in our editorial discretion.
We may edit submissions for matters including:
grammar, spelling, punctuation, length, clarity, structure, formatting, accessibility, headline style, visual presentation and consistency with Curly Lifestyles editorial standards.
We will not intentionally alter an interview quotation or contributor’s work in a way that materially misrepresents its substantive meaning.
Curly Lifestyles may determine placement, timing and promotion of accepted material.
15. Moral Rights
Canadian law recognizes certain moral rights separately from copyright ownership.
To the extent permitted by applicable law and reasonably necessary for Curly Lifestyles to exercise the licence granted under these Terms, you agree to waive and not assert moral rights in Submitted Content against Curly Lifestyles and persons authorized by Curly Lifestyles with respect to permitted editing, formatting, cropping, adaptation, publication, distribution and promotion.
This waiver does not transfer ownership of your copyright.
Where applicable law does not permit a particular moral right to be waived, this section applies only to the maximum extent legally permitted.
16. Your Promises About Submitted Content
When you submit content, you represent that you have the legal right to submit it and grant the permissions described in these Terms.
You also represent that, to the best of your knowledge:
the content is your own or you have obtained the rights necessary to use it;
our authorized use will not knowingly infringe another person’s copyright, trademark, privacy, publicity or other legal rights;
you have obtained permissions or releases from identifiable people where legally necessary;
you have appropriate authority before submitting private information about someone else;
and the submission does not contain material you know to be unlawfully defamatory, fraudulent or otherwise unlawful.
If you submit photographs or videos you did not create yourself, you are responsible for having permission from the copyright holder.
If a submission prominently features a minor, additional parent or guardian permission may be required.
17. Your Name, Biography and Likeness in Submitted Material
If you voluntarily provide your name, contributor photograph, biography, professional information, social-media handle or other information specifically for publication with your Submitted Content, you authorize Curly Lifestyles to publish and use that information in connection with the content and its promotion.
This section applies to material you voluntarily submit.
It is not intended to replace a separate media release that Curly Lifestyles may use when intentionally filming or interviewing people for editorial productions.
18. Contributor Profiles
Curly Lifestyles may permit contributors to maintain public profiles.
Public contributor information may remain associated with published articles after an account is closed where reasonably necessary to preserve authorship, editorial records and publication history.
Curly Lifestyles may remove or change contributor-profile functionality without removing legitimate published editorial archives.
19. Unsolicited Ideas and Feedback
Curly Lifestyles receives many ideas and may independently develop content similar to ideas proposed by others.
Unless we expressly agree otherwise before disclosure, unsolicited ideas, pitches, suggestions, business concepts, product concepts or general feedback should not be submitted on a confidential basis.
Providing unsolicited feedback or suggestions does not create a fiduciary, confidential or compensation relationship.
You grant Curly Lifestyles a non-exclusive, worldwide, royalty-free licence to use ordinary feedback and suggestions concerning our Services without compensation.
This section does not override the rights applicable to a formal story, photograph or contributor submission made through a designated submission process, which is governed by the Submitted Content provisions above.
20. Comments, Reviews and Community Features
Comments are generally disabled but may be enabled for particular content in the future.
If comments, reviews or other public-participation features are available, you remain responsible for what you submit.
Comments and reviews must reflect genuine opinions or experiences and must not be fabricated, purchased, fraudulently manipulated or submitted for an undisclosed improper purpose.
If you have received money, free products or another material benefit connected to a review or recommendation, you are responsible for making disclosures required by applicable law.
Curly Lifestyles may moderate, edit, refuse or remove content that we reasonably believe violates these Terms, applicable law, another person’s rights or our community standards.
We are not obligated to publish every submission and do not undertake to monitor every user submission before publication.
The opinions of users and contributors do not necessarily reflect the opinions of Curly Lifestyles.
21. Quizzes and Recommendation Tools
Curly Lifestyles may offer quizzes, questionnaires, assessments and recommendation tools concerning matters such as hair characteristics, hair routines, porosity, styling, products, salons or hairstylists.
Results may be generated automatically from answers provided by the user.
Quiz results are intended for editorial, informational or entertainment purposes and do not guarantee that a classification, product or recommendation is accurate or appropriate for every individual.
A quiz result describing a likely hair characteristic, scalp concern or similar issue is not a medical diagnosis.
Product or service recommendations may include affiliate relationships, sponsored placements or paid partnerships where disclosed.
Sponsorship of a quiz does not automatically mean that a sponsor controls every result or receives identifiable responses.

22. Professional, Medical and Beauty Information
Curly Lifestyles publishes general information and commentary concerning hair, beauty, styling, products, salons and related topics.
Articles, interviews, quizzes, videos and other content may include statements from hairstylists, barbers, colourists, trichologists, dermatologists, physicians, researchers, beauty professionals or other third parties.
Publication of such information does not create a doctor-patient, healthcare-provider-patient, stylist-client or other professional relationship with Curly Lifestyles.
Professional quotations represent the views or information attributed to the applicable source unless expressly stated otherwise.
Curly Lifestyles content is not a substitute for individualized medical diagnosis, treatment or other professional advice.
Additional terms concerning professional information, individual results and product recommendations are contained in our Disclaimer & Disclosures, which is incorporated into these Terms by reference.
23. Affiliate Links
Curly Lifestyles may earn compensation when users purchase products, book appointments or take other qualifying actions through affiliate links.
Unless expressly stated otherwise, when an affiliate link directs you to another company’s website, your transaction is with that third party, not Curly Lifestyles.
The third party is responsible for matters including:
its products and services; availability; pricing; payment; appointments; fulfilment; shipping; cancellations; returns; exchanges; refunds; warranties; customer service; and other terms applicable to the transaction.
Curly Lifestyles cannot process a return, cancellation or refund for a transaction made directly with an independent affiliate merchant, salon, hairstylist or booking platform.
You should review the third party’s terms before completing the transaction.
24. Salons, Hairstylists and Other Service Providers
Curly Lifestyles may feature, list, interview, recommend or link to salons, hairstylists, barbers and other professionals or businesses.
Unless expressly stated otherwise, these businesses are independent third parties and are not employees, agents or representatives of Curly Lifestyles.
A directory listing alone does not constitute a guarantee of a provider’s:
licensing, credentials, availability, pricing, safety, insurance, service quality, suitability or results.
Users should independently evaluate a professional and ask questions appropriate to their individual needs before booking or purchasing a service.
Curly Lifestyles is not a party to an appointment or service contract entered into directly between you and an independent salon, stylist or other third-party provider.
25. Sponsored and Commercial Content
Curly Lifestyles may publish sponsored articles, branded content, sponsored quizzes, advertising, affiliate recommendations and other paid partnerships.
Where required, material commercial relationships will be disclosed.
A sponsorship does not necessarily mean Curly Lifestyles personally guarantees a sponsor’s product or service.
Likewise, the presence of advertising next to an editorial article does not necessarily mean the writer, interview participant or person depicted endorses the advertiser.
26. Direct Purchases From Curly Lifestyles
Curly Lifestyles may sell physical or digital products directly through the Services.
Additional information concerning a particular product may appear on its product page or at checkout.
Your order represents an offer to purchase the applicable product.
Subject to applicable consumer law, Curly Lifestyles may decline or cancel an order before fulfilment because of circumstances such as product unavailability, suspected fraud, payment failure, legal restrictions or an obvious material pricing or listing error.
If we cancel an order after receiving payment and no product or service is supplied, amounts collected for the cancelled item will be returned as required by applicable law.
27. Prices, Taxes and Currency
Unless expressly stated otherwise, prices charged directly by Curly Lifestyles are displayed in Canadian dollars (CAD).
Applicable sales taxes may be added where required by law.
Shipping costs, where applicable, will be displayed or calculated as part of the purchasing process.
Curly Lifestyles does not intend to impose undisclosed mandatory fixed charges that make an advertised price unattainable.
International customers may also be responsible for customs duties, import taxes or similar governmental charges imposed by the destination jurisdiction unless we expressly state that those charges are included.
Prices, promotions and availability may change prospectively.
An advertised discount or sale does not alter purchases completed before the promotion began unless expressly stated.
28. Product Descriptions and Availability
We attempt to describe products accurately.
However, colours, proportions and visual appearance may vary depending on photography, lighting, manufacturing variation and screen settings.
Product availability is not guaranteed until the applicable order is accepted and fulfilled.
We may correct genuine typographical or technical errors, subject to applicable consumer law.
Nothing in this section permits Curly Lifestyles to make false or misleading product representations or to disregard mandatory consumer rights.
29. Physical Products — Final Sale
Unless Curly Lifestyles expressly states otherwise for a particular product:
all physical products sold directly by Curly Lifestyles are final sale and are not eligible for change-of-mind returns, refunds or exchanges.
This final-sale policy does not exclude any remedy, warranty, cancellation right or other consumer protection that applicable law says cannot be excluded.
30. Missing, Damaged, Defective or Incorrect Orders
Reports concerning a product that is alleged to be lost, damaged, defective, incomplete or incorrectly fulfilled will be reviewed case by case.
Submitting a report does not automatically entitle a customer to a refund, replacement or other particular remedy.
Curly Lifestyles may request reasonable information necessary to investigate a claim, which may include photographs, packaging information, tracking details, delivery information or other evidence.
Following investigation, Curly Lifestyles may provide a replacement, refund, credit or other resolution where we determine it is appropriate or where applicable law requires a particular remedy.
Nothing in this section limits consumer rights that cannot lawfully be excluded.
31. Shipping and Delivery
Shipping destinations, available delivery methods, rates and estimated delivery timeframes may be displayed at checkout.
Delivery dates are estimates unless expressly guaranteed.
Delays can occur because of carriers, customs, weather, labour disruptions, incorrect customer information, emergencies or other circumstances outside our reasonable control.
This section does not affect statutory cancellation or delivery rights that may apply when an order is materially delayed.
Customers are responsible for providing accurate shipping information.
32. Digital Products
Curly Lifestyles may sell downloadable products such as guides, PDFs, templates or other digital materials.
Unless expressly stated otherwise:
digital products are final sale once access or download begins, except where applicable law requires otherwise.
Where applicable law requires a customer to expressly request immediate access and acknowledge that beginning the download or supply causes the loss of a statutory withdrawal right, Curly Lifestyles may require that acknowledgement before providing immediate access.
Purchasing a digital product grants you a limited, non-exclusive, non-transferable licence to use it for your personal, lawful purposes unless a different licence is displayed with the product.
You may not, without written permission:
resell it; redistribute it; upload it publicly; share purchased copies with others; reproduce substantial portions commercially; remove proprietary notices; or use it to train or develop artificial-intelligence or machine-learning systems.
You should download and securely retain any downloadable files made available to you. Unless expressly sold as perpetual hosted access, Curly Lifestyles does not promise that a particular download link or account-based file will remain hosted indefinitely.
33. Payment Processing
Payment services may be provided by third-party payment processors such as WooPayments, Stripe, PayPal or other providers.
Your use of a payment provider may also be subject to that provider’s terms and privacy practices.
You authorize the applicable payment provider and Curly Lifestyles to process the charges you approve in connection with your transaction.
Fraudulent use of payment methods is prohibited.
34. Order Confirmation and Electronic Records
Where required by applicable law, Curly Lifestyles will provide information concerning the transaction before purchase and an opportunity to identify or correct relevant errors before the order is finalized.
We may provide order confirmations, receipts and other contractual information electronically, including by email.
You are responsible for providing a valid email address and retaining copies of purchase documentation you wish to keep.
Nothing in these Terms reduces any legal requirement for Curly Lifestyles to provide a retainable copy of a consumer agreement where such a requirement applies.
35. Contests, Giveaways and Promotions
Contests, giveaways and promotions operated by Curly Lifestyles will be subject to Official Rules or specific terms for the promotion.
Those rules may address matters including:
eligibility; geographic restrictions; age; start and closing dates; methods of entry; whether a purchase is required; prize number and approximate value; winner-selection procedures; skill-testing requirements where applicable; odds or factors affecting the chance of winning; notification; prize delivery; publicity permissions; and sponsor information.
If the Official Rules conflict with these Terms regarding a particular promotion, the Official Rules govern that promotion.
A person is not a winner until all applicable eligibility and verification requirements are satisfied.
Curly Lifestyles may disqualify fraudulent, automated, manipulated or otherwise ineligible entries in accordance with the applicable Official Rules and law.
36. Third-Party Websites and Services
The Services may link to websites or services that Curly Lifestyles does not own or control.
Links may include retailers, salons, hairstylists, booking platforms, advertisers, sponsors, affiliate merchants, social networks, payment processors, video platforms and other third parties.
A link does not necessarily constitute endorsement.
Curly Lifestyles does not control the independent third party’s terms, privacy practices, inventory, conduct or services.
Your interaction with the third party is governed by its own terms.
37. Editorial Interviews, Photography and Filming
Curly Lifestyles may conduct interviews and create photography, video and audio for editorial purposes.
Rights associated with a person intentionally participating in a Curly Lifestyles interview, filming session or other production may be governed by applicable law and, where appropriate, a separate media release or consent agreement.
These website Terms are not intended to substitute for a separate release where Curly Lifestyles determines that an individual media release is appropriate.
38. Copyright Complaints
Curly Lifestyles respects intellectual-property rights.
If you believe material published through Curly Lifestyles infringes copyright that you own or are authorized to enforce, please contact:
Your notice should identify the copyrighted work, identify the material you believe infringes it with enough information for us to locate it, provide your contact information, explain the basis of your claim and confirm that the information supplied is accurate to the best of your knowledge.
We may request additional information reasonably necessary to evaluate a complaint.
Curly Lifestyles may remove or restrict material where appropriate and may contact the contributor responsible for the material.
Knowingly submitting a materially false infringement complaint is prohibited.
39. Trademarks and Other Rights Complaints
If you believe material on Curly Lifestyles unlawfully infringes a trademark, publicity right, privacy right or other legal right, contact info@curlylifestyles.com and identify the material and basis of your concern.
Submitting a complaint does not guarantee removal.
Curly Lifestyles may evaluate the request in light of applicable law, editorial rights, freedom of expression and other relevant considerations.
40. Service Availability
We may modify, suspend or discontinue free website features or content.
We do not guarantee uninterrupted access to every page or feature.
Maintenance, security incidents, software errors, hosting outages or other circumstances may temporarily affect availability.
Where you have purchased a specific paid product or service, this section does not eliminate contractual or statutory rights concerning that purchase.
41. No Guarantee of Editorial Accuracy or Outcomes
Curly Lifestyles seeks to publish useful and responsible information, but information can become outdated, incomplete or incorrect.
Except where applicable law provides otherwise, we do not guarantee that every article, quotation, recommendation, price, external link or third-party statement will remain accurate, available or suitable for your particular circumstances.
Product results, hair results and service experiences vary between individuals.
Third-party opinions belong to the applicable speaker or source.
42. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, the free editorial and website portions of the Services are provided on an “as is” and “as available” basis.
Curly Lifestyles does not warrant that the website will always be uninterrupted, error-free, completely secure or free from harmful components.
We do not make an implied promise that general editorial information will achieve a particular personal, beauty, hair, medical, professional or commercial result.
This section does not exclude or disclaim any warranty, condition, guarantee or consumer right that applicable law says cannot be excluded, including mandatory rights that may apply to goods or digital content purchased directly from Curly Lifestyles.
43. Limitation of Liability
Nothing in these Terms excludes or limits liability that applicable law does not permit Curly Lifestyles to exclude or limit.
Subject to that principle, and to the maximum extent permitted by law, Curly Lifestyles Media Inc. and its directors, officers, employees, contractors and agents will not be liable for indirect, incidental, special, exemplary, punitive or consequential losses arising solely from use of the free Services, including lost profits, lost opportunities, loss of data or reputational harm, where such exclusions are legally permitted.
For claims arising exclusively from a user’s free use of the website and not from a direct purchase from Curly Lifestyles, our aggregate liability will, to the maximum extent permitted by applicable law, not exceed CAD $100.
That monetary cap does not apply where applicable law prohibits such a limit, including to mandatory consumer remedies or other liability that cannot legally be limited.
Curly Lifestyles is not responsible for the independent acts or omissions of third-party retailers, salons, hairstylists, booking platforms, advertisers or affiliate merchants merely because they were mentioned or linked through Curly Lifestyles.
Nothing in these Terms is intended to excuse Curly Lifestyles from responsibility for our own conduct where liability cannot legally be excluded.
44. Reliance on Professional or Third-Party Information
To the maximum extent permitted by law, Curly Lifestyles is not responsible for harm arising solely because a person substituted general editorial information for appropriate individualized professional care.

45. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Curly Lifestyles Media Inc. and its directors, officers, employees and agents from reasonable third-party claims, losses, liabilities and expenses arising directly from:
your unlawful use of the Services;
Submitted Content that you did not have the legal right to provide;
your infringement of another person’s intellectual-property, privacy or publicity rights;
your fraudulent or intentionally misleading conduct;
or your material violation of these Terms.
This obligation applies only to the extent the claim results from your conduct and does not require you to indemnify Curly Lifestyles for losses caused by Curly Lifestyles’ own conduct to the extent applicable law prohibits such allocation.
Curly Lifestyles will not settle a claim in a way that imposes a non-monetary obligation on you without your consent where your consent is reasonably required.
46. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without giving effect to conflict-of-law rules that would require application of another jurisdiction’s law.
However, if you are a consumer, nothing in this section deprives you of mandatory consumer protections that apply to you and cannot lawfully be waived by contract.
47. Courts and Disputes
For disputes that are not subject to a mandatory consumer forum or other jurisdiction that cannot legally be excluded, the parties submit to the courts located in Ontario, Canada.
These Terms do not require mandatory private arbitration and do not purport to waive a consumer’s right to participate in a class proceeding where such a waiver is prohibited or unenforceable.
Before beginning formal proceedings, you and Curly Lifestyles are encouraged, but not required where the law provides otherwise, to attempt in good faith to resolve the issue by contacting the other party.

48. Changes to These Terms
Curly Lifestyles may update these Terms prospectively as our website, store, contributor program, technology or business changes.
The revised Terms will display an updated “Last Updated” date.
Where a change is material, we may provide additional notice where appropriate or legally required.
Changes generally apply prospectively from their stated effective date.
A transaction already completed will not automatically be rewritten by a later version of these Terms where doing so would be prohibited by applicable law.
Where applicable law requires affirmative agreement to a material contractual change, we will seek that agreement rather than relying solely on continued use.
49. Electronic Communications and Notices
Where permitted by law, you agree that agreements, disclosures, notices, receipts and other communications relating to the Services may be provided electronically.
We may send account or transaction notices to the email address associated with your account or order.

50. Assignment
You may not transfer your contractual rights or obligations under these Terms to another person without our consent where the nature of the obligation is personal to you.
Curly Lifestyles may transfer these Terms in connection with a genuine merger, corporate reorganization, financing, acquisition or sale of all or substantially all relevant business assets, subject to applicable law and privacy requirements.
51. No Waiver
If Curly Lifestyles does not immediately enforce a provision of these Terms, that does not necessarily mean we have permanently waived the right to enforce it.
Any waiver applies only to the particular circumstances for which it was given unless expressly stated otherwise.
52. Severability
If a court or other competent authority determines that a provision of these Terms is invalid or unenforceable, the provision will be interpreted or limited to the minimum extent reasonably necessary to make it enforceable where legally permitted.
If it cannot lawfully be preserved, it will be severed.
The remaining provisions will continue to apply to the extent legally possible.
53. Entire Agreement
These Terms, together with policies and specific terms expressly incorporated into them, constitute the agreement governing your use of the applicable Services.
A specific written agreement signed or otherwise validly entered into between you and Curly Lifestyles may supplement or replace portions of these Terms for the activity it covers.
54. Survival
Provisions that by their nature are intended to continue after account closure or termination will survive, including provisions concerning intellectual property, published Submitted Content licences, payment obligations, disclaimers, limitations of liability, indemnification and dispute provisions, to the extent permitted by law.
